ExamCompass Terms and Conditions ("Agreement")

Please read these Terms and Conditions ("Agreement", "Terms and Conditions") carefully before using http://www.examcompass.com ("the Site", "Our Site") operated by ExamCompass ("Us", "We", "Our"). This Agreement sets forth the legally binding terms and conditions for users ("User", "You", "Your") of the Site at http://www.examcompass.com.

By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, You agree to be bound by these Terms and Conditions. Capitalized terms are defined in this Agreement.

Intellectual Property

The Site and its original content, features and functionality are owned by ExamCompass and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

Termination

We may terminate Your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with You. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Links To Third-Party Sites

Our Site may contain links to third-party sites that are not owned or controlled by ExamCompass.

ExamCompass has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third-party sites or services. We strongly advise You to read the terms and conditions and privacy policy of any third-party site that You visit.

Limited License

ExamCompass grants You a non-exclusive, non-transferable, limited license to use the Site in accordance with this Agreement. Any form of commercial use of the content available on the Site (including but not limited to practice exams) without the prior written consent of ExamCompass is strictly prohibited. Copying, repurposing, or republishing of the content available on the Site, whether online or offline, resulting in any form of revenue obtained from sale, advertising, subscription, or any other commercial application is expressly forbidden.

Any non-commercial use of materials available on the Site is not permitted without the prior written consent of ExamCompass. The non-commercial use of materials requires an attribution to the source and is limited to a reasonable extent. For the avoidance of doubt, "reasonable extent" shall mean an amount that does not constitute a significant portion of the content available on the Site, as determined by ExamCompass in its sole discretion.

Limitation Of Liability

In no event shall ExamCompass, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for damages, direct or consequential, resulting from Your use of the Site, and You agree to defend, indemnify and hold Us harmless from any claims, losses, liability costs and expenses, including but not limited to attorney's fees, arising from Your violation of any third-party's rights.

Warranty Disclaimer

The Site is not endorsed by Computing Technology Industry Association (CompTIA). Your use of the Site is at Your sole risk. The Site is provided on an "as is" and "as available" basis. The Site is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

ExamCompass, its subsidiaries, affiliates, and its licensors do not warrant that a) the Site will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Site is free of viruses or other harmful components; or d) the results of using the Site will meet Your requirements.

Governing Law

This Agreement, along with any additional rules, policies, or guidelines incorporated herein by reference, will be interpreted and enforced in accordance with the laws of Poland, without regard to any principles of conflicts of law. This means that any disputes arising from or relating to this Agreement or Your use of the Site will be resolved under Polish law, regardless of where You are located or where You access the Site.

Changes To This Agreement

We reserve the right, at Our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes Your acceptance of the new Terms and Conditions.

Please review this Agreement periodically for changes. If You do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.

This Policy is intended to provide the users of the Site ("User", "You", "Subscriber", "Visitor", or collectively "Users", "Subscribers", "Visitors") with information on what kind of data is collected by the Site about its Users and how the collected data is handled. By accessing and using the Site, You agree to be bound by this Policy. Capitalized terms are defined in this Policy.

Personal information collected on the Site

The personal information collected on the Site is restricted to names and email addresses, and this information is gathered only through contact and newsletter subscription forms available on the Site. Personal information collected through contact form enables Us to answer comments and questions submitted by Users. We use email addresses collected through newsletter subscription form to tell Subscribers about discounts on educational products.

The Site adheres to anti-spam policies, i.e. We do not send unsolicited emails to Users who do not request Us to do so by subscribing to the newsletter. We also do not send Subscribers messages that are unrelated to the general topic of the Site (computer education / IT certification training). We do not share any personal information submitted by Users / Subscribers with any third parties, however We may disclose this data if required by law.

Non-personally identifiable information collected on the Site

Log files
Like in the case of many other sites, We collect data which is stored in the server log files. The information inside the log files includes Internet Protocol (IP) addresses, type of browser, Internet Service Provider (ISP), date / time stamp, referring / exit pages, and number of clicks to analyze trends, administer the Site, track User movement around the Site, and gather demographic information. IP addresses and other such information are not linked to any information that is personally identifiable.
